Post subject: Can a landlord forcibly take over the apartment? Posted: Mon Oct 13, 2008 3:27 pm |

My daughter has a terrible relationship with the landlord. He has refused to get rid of the bugs inside the apartment and she has not been paying rent for living in an unhealthy environment. She is in the process of looking for a new apartment, but in the meantime she has not been making her monthly payments. The landloard is extremely angry and has been threatening to forcibly enter the apartment and take possession of it. Can he legally do this? Do we have any say in this matter?

Landlords can not take the law into their own hands and forcibly retake possession of their apartment. If a tenant refuses to leave voluntarily, the landlord must file a court action to regain possession of the apartment. Without the court order, your landlord can NOT take your apartment back. This is why it is always a good idea to read your lease carefully to avoid any of these issues.
